So everything should be regulated under the onerous Title II common carrier style regulation then?

This is not really what is happening though. Consumers are leaving copper and the costs to maintain the networks are rising. Some of these exchanges rely on 100 year old technology, so you can't buy parts anymore. It is not a "deep agenda," as much as it is a technical reality.

The court just handed the FCC a lot of power. I think they should table NN and work on cleaning their own house, the IP transition, and spectrum issues.
