No problem, scour vaguely-defined “history” until you find what you need. Still came up empty? Point to a “tradition” (whatever that means) and you’re good to go. Not to mention all the problems with turning judges into armchair historians, or the premise that whoever made the law 200 years ago was actually making scripture and would do the same thing today given current facts.

“(Text), history and tradition” is nothing but a Rorschach test. How serious people can say otherwise with a straight face blows my mind.
