Wrong. A Congressional review board and at least one federal judge have already determined that the NSA's current activity is illegal and must be stopped. And many of the revelations are just coming out. Only a tiny fraction have been subject to review. As someone with a juris doctor I can confirm the NSA has many programs that violate the 4th Amendment's prohibition on search and seizer. All they have done is opportunistically pretend the Bill of Rights doesn't exist in the digital realm because it's relatively new. The only question is how slavishly authoritarian the stacked federal courts are in America in 2014.
