I agree with you in principle, but we are just doing society a disservice. Jail is a form of rehabilitation and people make mistakes, sometimes really big ones for which they have legitimate remorse. The jail time is not really a punishment sometimes, but simply an addition to the punishment which is guilt. Sometimes the crime suggests a lack of humanity on the part of the guilty, for which rehab is not really all that likely. These people belong in jail because society is endangered by their being a part of it. Some murderers do not pose this threat to society and keeping them locked up doesn't really do much except waste our tax dollars.

edit: for clarification, I am not a supporter of our judicial system. I think it punishes people arbitrarily with consequences that do not correlate with the crimes. I am simply saying that an eye for an eye leaves the world blind and we are capable of figuring out a better system. Fair is not necessarily good.

Very true... our prison system does a very inadequate job of rehabilitating criminals back into society. Since my original comment makes me come off as defending that system I should clarify that comment and I will.
