If you're at a party and everyone is your age and one woman who looks and acts like the same age it's not likely you're gonna ask their age. Mistakes happen IMO. Just because she was 15 doesn't mean she was retarded.

That being said, this is the convicted party's side of the story so she very likely could have been very obviously underage.
