Hi Mr. Polis.

Certain municipalities in Colorado are attempting to keep marijuana illegal in their jurisdictions. Some still write tickets for marijuana paraphernalia, accessories explicitly legalized in the state constitution. What can be done to see that these municipalities respect the will of the voters of Colorado?

Thank you for your response. I understand that many localities will choose to prohibit the sale of marijuana, but it was my understanding, according to the amendment, that possession of marijuana and marijuana accessories "shall not be an offense under Colorado law or the law of any locality within Colordado".

It's very alarming. Denver ignores the part about concentrate, Greenwood Village ignores the part about transporting, Sheridan ignores the part about accessories. Apparently we can't trust police chiefs to even read what is signed into law.

Is it correct that the ability for a municipality to "opt-out" of retail cannabis does not affect the paragraph you've cited here?

This is straight from the Amendment:

(f) “MARIJUANA” OR “MARIHUANA” MEANS ALL PARTS OF THE PLANT OF THE GENUS CANNABIS WHETHER GROWING OR NOT, THE SEEDS THEREOF, THE RESIN EXTRACTED FROM ANY PART OF THE PLANT, AND EVERY COMPOUND, MANUFACTURE, SALT, DERIVATIVE, MIXTURE, OR PREPARATION OF THE PLANT, ITS SEEDS, OR ITS RESIN, INCLUDING MARIHUANA CONCENTRATE. “MARIJUANA” OR “MARIHUANA” DOES NOT INCLUDE INDUSTRIAL HEMP, NOR DOES IT INCLUDE FIBER PRODUCED FROM THE STALKS, OIL, OR CAKE MADE FROM THE SEEDS OF THE PLANT, STERILIZED SEED OF THE PLANT WHICH IS INCAPABLE OF GERMINATION, OR THE WEIGHT OF ANY OTHER INGREDIENT COMBINED WITH MARIJUANA TO PREPARE TOPICAL OR ORAL ADMINISTRATIONS, FOOD, DRINK, OR OTHER PRODUCT.

This would not be the first time a police department felt like ignoring part of the amendment.
