Is there not a fair use case to be made for photoshopping an image with the intent to create a derivative work of parody? If the nature of the work is not to incite violence or to slander and results in a new work, why should the content of the work be subjected to further scrutiny?

Questions!

1. Do you think we'll see a sort of "unified theory" of sorts for the biological processes responsible for pair bonding/relationship building within the next decade? e.g., how do things like oxytocin, vasopressin, endorphines, etc. influence the strength of an existing relationship, and vice versa how does an already complex relationship impact the biological functions of the brain?

2. How do you think the recent research on how the brain handles moral dilemmas through rational vs emotional conflict resolution will impact our understanding of relationships with other people and things?

3. What do you think about PNI (psychoneuroimmunology) as an emerging field? Does it seem like the neuroscience world is welcoming the convergence of physical and psychological health?

4. This is a bit of a self-interest question but with the amount of data coming out of most neuroscience research projects, from a technical/IT perspective, where are the major pain points in working with this data on a day to day basis? What hinders or slows down your research that could be improved upon? (tech guy here, always looking for opportunities to help advance science!)

5. Last but certainly not least, with the technological singularity ever looming in the next 20-40 years, and the possibility of creating an artificial brain capable of housing complex neural interactions similar to an organic brain, how the hell are we going to get our biological consciousness into an artificial substrate, and how do you personally think it will impact perception, perspective, identify, and consciousness? Ship of Theseus kind of deal or can we expect some kind of a buffering/loading transfer situation?!

I don't know the exact letter of the law but from my understanding if the image is accessible through means that are in-line with the original intended use (e.g., images that are publicly accessible on a website) and a person saves that image, and uses it to create a new derivative work, as long as it can pass the litmus test outlined for what qualifies as fair use, there shouldn't be any licensing or copyright issues. Again, this is just based on my understanding from working in the journalism industry for a while. I've had to build several rights management systems so I had to understand some aspects, but clearly not all, or what public accessibility and fair use looks like.

So if the images are private and require circumventing any measure of security and there is a reasonable expectation of privacy, that would be against the law and the images could possibly be considered slander or defamation depending on the intent and how it might impact the "marketability" of the person in the image.

I just wouldn't want to see a piece of blanket legislation stomping out one set of rights (fair use) on the charge of another without some really careful consideration. This subject matter is extremely emotionally charged, and lots of emotions generally lead to knee jerk decisions. That's why I think it's important to challenge the work she is doing, not because I disagree with it in any means but because it needs to be done in an extremely rational and well framed context.

I don't have a problem with fighting for something that protects the rights of people, but it's in poor taste to compare hacking an email account and hosting nude photos to one of the most notorious psychopaths in history. Giving the order to murder and eviscerate a pregnant woman with the hopes it will incite a racial world war is in no way comparable. Either you're severely making light of the victims of the Manson family, or you're trying to create equivalency between murder and hosting nude pictures.

You should reconsider these comments, they do nothing to help promote individual rights advocacy.

This doesn't have anything to do with your question but I wanted to share my thoughts with you about what you've been experiencing. I cannot imagine the suffering and turmoil that must be in your mind right now. We use the term pets but they are such an essential part of our families and our lives aren't they? What you did for her in the last moments of her life was an act of compassion that cannot be put into words.

It's hard to look past the pain of losing a life that we are so connected to, and only time will bring you relief. But when that relief comes, what will remain will be the result of sharing 15 years of your life with an amazing companion whose mark will forever be a part of who you are. Take the time to grieve, let yourself be aware and feel that pain, and use this time to reflect on how this wonderful girl tempered you into the person you are today.

You have my deepest condolences and respect. Thank you for sharing this to remind us that we are capable of being gentle, understanding, and compassionate during the most difficult times in our lives.
