You have to remember as well that those judges are elected. Shutting down a case (which is actually pretty hard to do because it leaves room for mistrial or reversible error - better to let both sides hash it out and do their best to prove their case, because crap will show itself to be crap on the record, presumably) is like instant negative ad-fodder. "Judge X works for SEX OFFENDERS! Do you want him on the bench next year?!"
