Drugs are unique in the criminal justice system. They carry very heavy sentences and confiscation of assets even at what can easily be said to be a paltry crime.

The increase in jail terms and numbers from drugs well predates the rise of private jails. The nonsense of the drug war was an infraction by the state not private enterprise (unless you blame dupont and dow for Marijuana becoming villanized).

Private jails have taken advantage of this system but they did not create it, the state did.

Using drugs as an excuse to search private vehicles at traffic stops, as a reason to employ the many in the government from yes most prison guards, prosecutors and other law enforcement.

Blaming private jails for the nonsense of the drug war is like blaming credit unions for their increasing popularity on them being responsible for the bank crash.

Besides drugs offenses tell me what criminals are artificially filling up these jails? None. Privatized system is fine with accountability.
