Just so we are clear, you are holding Ladar accountable for the US Goverment suppressing their capability to intercept/store and decrypt all internet traffic illegally regardless of the restrictions enshrined in the Constitution they are supposed to respect ?

I read https://web.archive.org/web/20130805154113/http://lavabit.com/secure.html before using the service and at no point did I misunderstand that if the servers private key was compromised my email would not be safe.

The product of this encryption process is a message that is cryptographically impossible to read without the password. We say cryptographically impossible because, in theory, an attacker with unlimited computing resources could use brute force to decipher the original message. However in practice, the key lengths Lavabit has chosen equal enough possible inputs that a brute-force attack shouldn’t be feasible for a long time to come.

Could it have been explained better ? Sure, i'll give you that.. however at no point did I think the US Goverment would illegally invade all of the users privacy to get at one. How wrong I was.

EDIT - While I am on this soapbox i'll leave this here.. It really defines the insanity of the NSA revelations and makes you think about where all this is going.
