It creates a perverse incentive if the crew members whose own lives aren't on the line can get an award for putting someone else's life on the line.

The United States grants asylum to those who can demonstrate that they have been persecuted or legitimately fear persecution on account of their religious beliefs. Whether or not it's granted depends often on the whim of bureaucrats and judges though. Factors they consider is whether the persecution suffered or feared is "bad enough" or whether there's evidence that the reason for that persecution was actually based on religious belief. It can be a scary process since people fleeing their home country don't usually have the benefit of bringing a lot of evidence with them.

As one of the attorneys who went to the airport to help fix the "clusterfuck", my job is not at risk answering this question for him. The first executive order was so poorly written, it might as well have been scribbled in crayon. There was no indication whether it applied to dual citizens or legal permanent residents, there was no phase-in time period to account for travelers who were already in flight, and it didn't acknowledge the validity of any visas, even diplomatic visas, from any travel ban countries. Generally, laws come with extensive guidance in how to enforce them, but being a rushed executive order, much of this one boiled down to "Here's the overall picture: immigrants are dangerous. Make it happen." I did not envy CBP agents at all when they had to try to decipher it.

Is the Lakota People's Law Project at all involved with pursuing clemency for Leonard Peltier? If so, has there been any hint of possibility along that front for the end of Obama's term?
