Broadcasting does have to be controlled in some fashion. Interference between allocated channels is the main issue for many nations around the world.

Look, I'm not really sure if there is a better way to manage it... Pirate radio broadcast stations do exist. But they cause havoc for legal operators. If it was a free for all the person with the most money would win anyways because they would have the most powerful transmitter. There is a finite amount of spectrum space, just like there is a finite amount of oil.

Anyone can launch a satellite. you just need stacks of cash

Whether your cable box is on or not is irrelevant. The signal still comes down the line. Just like FTA Digital TV signal still gets broadcast whether your TV is on or not.
