I work at a Plaintiffs med mal firm in Tx. At least in Texas, legislation against Plaintiffs is 100% a partisan issue, and particularly in medmal. Even right wing attorneys vote Democrat in local and state elections because of this. If you want citations, look at the legislation over the past 20 years, Ch 74 CPRC.

Yeah, I mean, for example, oddly enough Florida (red state) is still a great state to pursue med mal in. it's a state by state thing, generally it seems to be a partisan issue, but obviously not exclusively. Trends are just trends and don't always mean reality.

I think it's more a matter of insurance companies have successfully lobbied to republicans in these particular states and have been unsuccessful in their lobbying attempts in other states. Not so much a matter of "regulation" in my opinion.

Insurance lobbyist even tried to sneak in federal caps on noneconomic damages on Trump's/Republicans failed healthcare bill this past winter, so not a regulation thing so much as a lobbyist interest.

People who think politicians are actually ideologically consistent (fiscal responsobility, state vs federal debate regulations) are extremely naive. Lobbyists run the show (as we saw with net neutrality).
