Yes. Also some states limit who can be appointed to those which are first vetted for qualifications by an independent/non partisan committee. Essentially, you're removing quite a bit of the politics from the decision.

I have graded practice exams for the CA bar. I passed in July 2010 on my first try.

In California the essay portion is extremely dependent on format and structuring. I used to hammer people on organization and making it easy to read and find answers for the graders. In CA graders get paid per exam and they spend on average 45-90 seconds per essay. Would you say that's similar behavior in NY?

I found that is one of the hardest parts for a lot of people in CA - being able to quickly and succinctly capture the issue and analysis in a quick and easy to read format (which might explain why some legal scholars fail - tendency for overwriting).
