With the rise of the EFF and other advocacy groups, do you think you would have been able to get a better lawyer and a better outcome today?

What are we (congress) doing about places like China where IP law is non-existant?

With the naufacturing capabilities (including labor costs) in China so low, it is difficult resisting manufacturing your product in China (or at least components) - but I would be reluctant to send the plans to something I invented to a place where it will be stolen and sold without my knowledge or permission.

The BMW X5 case and the fake Apple stores are perfect examples of the broken system there.

Thanks for the answer but reforming our patent and IP laws here can only go so far in a global economy if the same protections aren't provided elsewhere.

Maybe my incentive is to not innovate due to the risk of the very people that are making the pricing of my product attractive, stealing my innovation.

This is slightly off the topic of CISPA but what does the EFF think and more more importantly, what is the EFF doing about the current flood of infringement lawsuits/extortion schemes being filed by porn companies. Just last week another 2500 defendants were joined in mass lawsuits in Fl, PA, DC and CA. Same pattern as always, file mass suit against John Does, subpoena IP records, then harass and threaten being named unless you pay $1,500-5000. Since it typically costs more than $1000 to defend, they have found a way to legally extort money from people.

Thanks Jay, I wasn't aware of most of that. With the recent Florida and West Virginia rulings going against the Trolls do you see a change in tactics coming? You would think that in light of some of the harsher rulings they would be backing off but it seems that the filings are only increasing. Any ideas why?
