I'm guessing that in this case, there'd likely need to be a legal battle to determine if AirBnB renters had a legal expectation of privacy in the "public" rooms of a house they were renting.

No, there wouldn't need to be any sort of legal battle. This is already well-established. Hotels can't videotape you having sex in the in-room hot tubs, either.

I suppose it's possible that AirBNB or a host might try to raise that as a defense, but they'd lose on that argument quite handily.
