Class action suits have benefits in that you have to do a lot less work for the case (among other things), but they are about punishing the defendant, not really getting restitution for the plaintiff.

If you want though, you can choose to opt out of a class action and sue individually.

I had a very similar situation! My dad and I both had root canals at the same oral surgeon's office, and they lost my insurance paperwork and filled it out themselves (even forging my signature!), but put his information on it instead of mine.

After trying to get them to bill the right insurance for awhile, eventually they told me they got it sorted out. I didn't hear anything for several years, until one day a debt collector started calling, and getting really nasty too. I got their address, and sent them a letter (should have sent it certified, I got lucky) telling them to stop contacting me, except to prove the debt was real (this is a validation letter).

Never heard from them again.

I misread your summary of Reckless as involving a magician, and now I'm wondering: is magician too unsexy of a profession to include in a romance novel? Is this a challenge you would ever tackle?

I'm not sure what you're saying here. The OP claims that he went in for one particular operations but received something else. He's not claiming the doctor jumped him in an alley and performed surgery on him.
