I studied Criminology in college and am currently a lawyer. From the studies that I have seen, the harshness of the punishment is not a substantial deterrent to the majority of crime. Rather, the likelihood (or unlikelihood) of getting caught has a much greater impact on a criminal's decision to commit said crime or not.
