The local municipalities rely on "public good" or "public interest" as the justification. Assuming a municipality was silent on the matter or was considering a policy, what do you think is the best solution? The next door neighbor and the gardener both rely on property rights to advance their positions. The neighbor complaining of diminished property value and nuisance.
