The only viable way for third parties to make a difference is to concentrate their resources down the ballot, where they actually could go toe-to-toe with the big ones. I have no clue why they don't realize this.

It's my personal belief, fwiw, that there is a compelling public interest to prevent the spread of hateful ideas. I have practical concerns though, such as the risk of drawing attention to an idea by prosecuting them, or governmental overreach (for example, conflating criticism of Israel with antisemitic speech).
