Where do you live that no one would take your case? I'm a lawyer in Texas. Anywhere between a third and a half of the appeals that come across my desk (I only do appeals) are med mal cases.

What on Earth is "aspirational" about A&F? They sell overpriced sweatpants that are worn by every skinny teenager who has access to Daddy's credit card. That trash is in every mall in America. It's not like he's selling fucking Hermes.

As soon as I saw 615 hours of grading, I knew you were an English teacher. I'm not an English teacher anymore, but I used to be, and in my experience, teachers from other disciplines really don't understand how much time it takes to grade English assignments.

Was the hospital involved associated with a university by any chance? The cap is even lower ($100,000) if you want to sue an arm of the state of Texas, and hospitals associated with public universities qualify as an arm of the state. There are also a number of other procedural hurdles you have to jump to sue a government entity, which makes suing those hospitals a giant PITA.

If this happened when she was 29, and she's 33 now, she's time barred. The statute of limitations on med mal in Texas is two years.
