I think they are asking why did Florida start allowing first time DUI charges to have the option to be reduced to a reckless driving charge?

If someone were to be driving under the influence but cause no damage to anyone or any property, is there more of a chance for the charge to become a reckless driving charge?

Yes that helps, thank you!
A follow-up questions, if one get's pulled over for a DUI charge, how soon after should I contact an attorney? Can you explain more on how an attorney can help? Does it help to take photos at the accident?
