Mary Anne Franks and I have been working with House and Senate staff on prohibiting digital forgeries causing cognizable harm like defamation, privacy invasions, etc. Law needs to be carefully and narrowly drafted.
Do you have any concern that new legislation may end up being overly broadly drafted when looking at was to minimize the damage potential of deepfakes? Would faked videos fall under existing defamation laws or would it take alteration for a faked video to be considered 'speech' by the editor rather than by the subject of the video?
