I couldn't-can't think of the word, but it's given a punishment not just forbidden. You could also tack on the denial of liberty, and the pursuit of happiness.

Why isn't he being accused of treason?

I know I'm just wondering, why not use it since it's the only law/crime outlined in the constitution?
