In the last AMA Officer Murray claimed that marijuana concentrates are illegal. Since Amendment 64 defines "marijuana" as both flowers from the plant and concentrates, could you please clarify how one could be legal and not the other?

(f) “MARIJUANA” OR “MARIHUANA” MEANS ALL PARTS OF THE PLANT OF THE GENUS CANNABIS WHETHER GROWING OR NOT, THE SEEDS THEREOF, THE RESIN EXTRACTED FROM ANY PART OF THE PLANT, AND EVERY COMPOUND, MANUFACTURE, SALT, DERIVATIVE, MIXTURE, OR PREPARATION OF THE PLANT, ITS SEEDS, OR ITS RESIN, INCLUDING MARIHUANA CONCENTRATE. “MARIJUANA” OR “MARIHUANA” DOES NOT INCLUDE INDUSTRIAL HEMP, NOR DOES IT INCLUDE FIBER PRODUCED FROM THE STALKS, OIL, OR CAKE MADE FROM THE SEEDS OF THE PLANT, STERILIZED SEED OF THE PLANT WHICH IS INCAPABLE OF GERMINATION, OR THE WEIGHT OF ANY OTHER INGREDIENT COMBINED WITH MARIJUANA TO PREPARE TOPICAL OR ORAL ADMINISTRATIONS, FOOD, DRINK, OR OTHER PRODUCT.

Officer Murray also stated that it was illegal to buy marijuana. What laws would someone be charged with for buying less than one ounce of marijuana?

NOTWITHSTANDING ANY OTHER PROVISION OF LAW, THE FOLLOWING ACTS ARE NOT UNLAWFUL AND SHALL NOT BE AN OFFENSE UNDER COLORADO LAW OR THE LAW OF ANY LOCALITY WITHIN COLORADO OR BE A BASIS FOR SEIZURE OR FORFEITURE OF ASSETS UNDER COLORADO LAW FOR PERSONS TWENTY-ONE YEARS OF AGE OR OLDER: (a) POSSESSING, USING, DISPLAYING, PURCHASING, OR TRANSPORTING MARIJUANA ACCESSORIES OR ONE OUNCE OR LESS OF MARIJUANA.

Also, I hope it's not too late but /u/A64Attorney is not associated with the Denver Police Department doing this AMA. He has graciously lent his time and knowledge after being asked to help clarify some of the misinformation concerning marijuana that's been presented by the Denver Police Department.

This is unsettled and we are waiting for direction from the State Legislature and prosecutors.

But does this mean that you are currently citing folks with engaging in a conspiracy or are you waiting until things are cleared up?

Is it considered legal then to consume MJ in your own vehicle, in a secluded place in public? and then leave all things related to it in your vehicle?

Absolutely not. Much like you can't drink in your car, even if the keys aren't in the ignition.

Can I go hiking and do it? etc

Legally, no. The only place marijuana may be consumed is within a residence or private venue with the property owner's permission. The only exception to this is in the city of Boulder who has elected to define residence as any part of the property, even if in view/smell of the public. But it still must be on private property.
